EXERCISING THE RIGHT OF WITHDRAWAL

Good news! You have the right to withdraw from this contract within 30 days without giving any reason.

The withdrawal period will expire 30 days after the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform us (Poka Premium, ul. Gliwicka 120B, 43-190 Mikołów, Poland) of your decision to withdraw from this contract by means of a clear statement (for example, a letter sent by post or e-mail).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery (except for any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than 30 days from the day on which we are informed of your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever occurs first.

Please send back or hand over the goods to us without undue delay and in any event no later than 30 days from the day on which you informed us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of 30 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

STATUTORY WARRANTY CLAIMS (CONSUMER COMPLAINTS)

If a defect is discovered, you have the right to:

• submit a statement requesting a price reduction;
• submit a statement withdrawing from the contract, unless the defect is insignificant;
• request replacement of the goods with defect-free goods;
• request repair of the defect.

We will respond to your statement or request within 14 days.

To exercise the right of withdrawal, you must inform us (Poka Premium, ul. Gliwicka 120B, 43-190 Mikołów, Poland) of your decision to withdraw from this contract by means of a clear statement (for example, a letter sent by post or e-mail).

You are required to deliver the defective goods to us at our expense to the following address: Poka Premium, ul. Gliwicka 120B, 43-190 Mikołów, Poland. If delivering the goods would be excessively difficult for you (for example, due to the nature of the goods or the manner in which they are installed), you are required to make the goods available to us at the location where they are situated.

We bear the costs of replacement or repair, except where the defective goods have been installed. In such a case, you are required to bear the portion of the costs that exceeds the purchase price of the goods. Alternatively, you may request that we reimburse part of the costs of dismantling and reinstallation, up to the value of the purchased goods.

We are liable under the statutory warranty if a physical defect is discovered within two years from the date the goods were delivered to you, or within one year if the subject of the sale was used goods. Your rights under the statutory warranty may be exercised within one year from the date on which the defect was discovered; however, this period shall not expire before the end of the applicable statutory warranty period (two years for new goods or one year for used goods from the date of delivery).

An exception applies where the expiry date for the use of the goods specified by us or the manufacturer ends after the above-mentioned period. In such a case, we remain liable under the statutory warranty for physical defects discovered before that expiry date.

Liability for legal defects is generally subject to the same rules. The period for submitting claims begins from the moment you become aware of the defect, while limitation periods are calculated from the date on which a final court judgment concerning the item affected by the legal defect becomes legally binding.

The statutory warranty is a complex legal matter. We encourage you to familiarize yourself with the provisions of the Polish Civil Code, as well as information provided by the Polish Office of Competition and Consumer Protection (UOKiK) and consumer organizations, which explain consumer rights in detail. Our store operates in full compliance with applicable law and respects consumer rights, therefore the information provided by these institutions also applies to contracts concluded with us.
